1. Who may use Nowly

1. من يحقّ له استخدام Nowly

You must be 16 or older. If you are under 18, you confirm that your parent or guardian has agreed to you using Nowly. You must not be barred from using the service under the laws that apply to you, and you must not create a new account after we have removed a previous one. A parent or guardian who allows a person under 18 to use Nowly is responsible for that use. If we learn that someone is under 16, we close the account.

يجب أن يكون عمرك 16 عامًا أو أكثر. وإن كان عمرك دون 18 عامًا، فإنك تؤكّد أن وليّ أمرك وافق على استخدامك Nowly. ويجب ألا تكون ممنوعًا من استخدام الخدمة بموجب القوانين السارية عليك، ولا يجوز لك إنشاء حساب جديد بعد أن نكون قد حذفنا حسابًا سابقًا لك. ويتحمّل وليّ الأمر الذي يسمح لمن هو دون 18 عامًا باستخدام Nowly المسؤولية عن ذلك الاستخدام. وإن علمنا أن عمر شخص دون 16 عامًا أغلقنا حسابه.

Nowly is not offered in the European Economic Area (the 27 EU member states, Norway, Iceland and Liechtenstein) or in the United Kingdom. Elsewhere, availability — and some features — may vary by country. The 16+ rule applies in every country.

لا يُتاح Nowly في المنطقة الاقتصادية الأوروبية (الدول الأعضاء السبع والعشرون في الاتحاد الأوروبي والنرويج وآيسلندا وليختنشتاين) ولا في المملكة المتحدة. وفي غيرها قد يختلف توفّره — وبعض ميزاته — من بلد إلى آخر. وشرط 16 عامًا فأكثر يسري في كل البلدان.

From your birth year, four protections apply automatically, with nothing to switch on:

• The place on your moments is shown only to your mutual friends. Everyone else sees the city at most, and you are not counted or shown among a place's regulars («Locals»), who is there now, on place pages or in nearby lists

• Direct messages come only from mutual friends. Message requests from anyone else do not reach you

• Location lobbies are not shown, because entering one shows that you are at the place. Public and private lobbies work as normal
• لا تظهر لوبيات اللوكيشن، لأن دخولها يُظهر أنك في المكان. أمّا اللوبيات العامة والخاصة فتعمل كالمعتاد
• The couples items and heart lines are not shown until 18

Purchases go through Apple, where Family Sharing and Ask to Buy apply if your family uses them. Because we ask for your birth year only, these protections stay until 1 January after the year you turn 18, then everything opens by itself.

وتتمّ المشتريات عبر Apple، وتسري فيها «مشاركة العائلة» و«طلب الشراء» إن كانت عائلتك تستخدمهما. ولأننا لا نسأل إلا عن سنة الميلاد، تبقى هذه الحمايات حتى 1 يناير من السنة التي تلي بلوغك 18 عامًا، ثم يُفتح كل شيء تلقائيًّا.

2. Your account

2. حسابك

Your account is a username and a password, and it works on any phone. Your email address is confirmed with a code when you sign up and is used only to send you codes and to recover your account. You are responsible for what happens under your account. Keep your password to yourself, and tell us at once if you think someone else has access.

حسابك اسم مستخدم وكلمة مرور، ويعمل على أي جوال. ويُؤكَّد بريدك الإلكتروني برمز عند التسجيل، ولا يُستخدم إلا لإرسال الرموز إليك واسترجاع حسابك. وأنت مسؤول عمّا يجري من خلال حسابك، فلا تُطلع أحدًا على كلمة المرور، وأبلغنا فورًا إذا ظننت أن شخصًا آخر تمكّن من الوصول إلى حسابك.

When you sign up you accept the version of these terms in force at that time, and we record which version you accepted and when. If we change them, section 2A below applies.

وعند التسجيل توافق على نسخة هذه الشروط السارية حينها، ونسجّل النسخة التي وافقت عليها ووقت موافقتك. وإن عدّلناها فيسري البند 2أ أدناه.

2A. Changes to these terms

We may update these terms, for example when we add a feature or when the law changes. We will tell you of a change by reasonable means, in the app. The date at the top shows the current version. If you keep using Nowly after a change takes effect, you accept it; if you do not agree, you can delete your account.

يجوز لنا تحديث هذه الشروط، كأن نضيف ميزة أو يتغيّر القانون. وسنُعلمك بالتعديل بوسيلة معقولة داخل التطبيق. ويبيّن التاريخ في أعلى الصفحة النسخة الحالية. وإن واصلت استخدام Nowly بعد سريان التعديل فقد قبلته، وإن لم توافق فبإمكانك حذف حسابك.

3. What you may not post

3. ما لا يجوز نشره

There is no tolerance for any of the following. Posting it will get the content removed and, in serious cases, your account removed without warning.

لا تسامح إطلاقًا مع أي مما يلي. ويؤدي نشره إلى حذف المحتوى، وفي الحالات الجسيمة إلى حذف حسابك دون إنذار.

• Nudity, sexual content, or anything sexualising a person
• العُري، أو المحتوى الجنسي، أو أي محتوى يُضفي طابعًا جنسيًا على شخص
• Child exploitation, or any sexual content involving a minor — the account is locked at once and it is reported to the authorities, not merely removed
• استغلال الأطفال، أو أي محتوى جنسي يتضمّن قاصرًا — ويُقفل الحساب فورًا ويُبلَّغ عنه إلى السلطات، ولا يُكتفى بحذفه
• Intimate images of a person without their consent, including images made with AI

• Violence, gore, or content that celebrates or threatens harm

• Hate speech, or content promoting a terrorist or extremist organisation

• Harassment, bullying, threats, or posting someone's private information

• Content that violates Bahraini law, public decency, or Islamic values

• Spam, scams, or impersonating another person or business

• Photographs of people who have made clear they do not wish to be photographed

Nudity means bare breasts or genitals. Swimwear is fine, and so are ordinary photos of your family and your own children, at the beach or anywhere else.

والمقصود بالعُري ظهور الصدر أو الأعضاء التناسلية. أمّا لباس السباحة فمسموح، وكذلك الصور العادية لعائلتك وأطفالك، على البحر أو في أي مكان.

4. Comments

4. التعليقات

Comments follow the same rules as photographs. Everything in section 3 applies to what you write under someone else's moment.

تخضع التعليقات للقواعد نفسها التي تخضع لها الصور. فكل ما ورد في البند 3 ينطبق على ما تكتبه تحت لحظة شخص آخر.

Whoever took the photograph can delete any comment under it. That is deliberate — the person whose moment it is decides what sits beneath it, and they do not need a reason. If your comment is removed, that is why.

يستطيع من التقط الصورة حذف أي تعليق تحتها. وهذا مقصود — فصاحب اللحظة هو من يقرّر ما يظهر تحتها، ولا يحتاج إلى إبداء سبب. فإن حُذف تعليقك، فهذا هو السبب.

Comments disappear when the post does — when its time is up (4 hours, or up to 24 for a VIP member's pick), or when a saved moment is deleted. Likes disappear with the post too.

تختفي التعليقات باختفاء المنشور — عند انتهاء مدتها (4 ساعات، أو حتى 24 ساعة لمشتركي VIP)، أو عند حذف لحظة محفوظة. وكذلك تختفي الإعجابات معه.

5. Messages

5. الرسائل

By default, only mutual friends — people you follow who also follow you — can message you. In Settings, under "Who can message me", you can choose Mutual friends (the default) or Everyone.

افتراضيًا، لا يراسلك إلا الأصدقاء المتبادلون — من تتابعهم ويتابعونك. ومن الإعدادات، في «من يستطيع مراسلتي»، تختار بين «الأصدقاء المتبادلون» (الافتراضي) و«الجميع».

If one of you blocks the other, or someone is no longer allowed to message you under your setting, the conversation closes. Nothing is deleted; you simply cannot write again.

إذا حظر أحدكما الآخر، أو لم يعد مسموحًا لشخصٍ بمراسلتك وفق إعدادك، تُغلق المحادثة. ولا يُحذف شيء، لكن لا يمكن الكتابة فيها مجددًا.

Everything in section 3 applies to what you write in a message. Messages are screened the same way captions are, and one that breaks the guidelines is refused before it sends. Links are not allowed in messages.

كل ما ورد في البند 3 ينطبق على ما تكتبه في الرسائل. وتُفحص الرسائل بالطريقة نفسها التي تُفحص بها النصوص المرافقة للصور، وتُرفض الرسالة المخالفة للإرشادات قبل إرسالها. ولا تُقبل الروابط في الرسائل.

We don't browse your messages. We may view a conversation when needed to investigate a report, protect someone's safety, or respond to a legal request.

لا نتصفّح رسائلك. قد نطّلع على محادثة عند الحاجة للتحقيق في بلاغ، أو لحماية سلامة الأشخاص، أو لطلبٍ نظامي.

Stories on your home screen come only from mutual friends. Swiping up on a story sends its author a private reply only if their message setting allows you; otherwise their profile opens.

القصص في صفحتك الرئيسية لا تأتي إلا من الأصدقاء المتبادلين. والسحب للأعلى على قصةٍ يرسل لصاحبها ردًّا خاصًّا إن سمح لك إعداد الرسائل عنده، وإلا فُتح ملفه.

With "Everyone", a first message from someone you don't follow each other with waits in Message requests — text only, a few at most — until you accept it.

ومع «الجميع» تنتظر أول رسالة ممن لا تتبادل معه المتابعة في «طلبات الرسائل» — نصًّا فقط، وبضع رسائل على الأكثر — حتى تقبلها.

Messages and voice messages disappear after seven days, and chat photos after 24 hours. Chat photos come from the camera or from one photo you pick with your phone's photo picker; they are checked on your phone like any other photo. You can delete a message for everyone within 15 minutes of sending it (not a gift, and not once it has been reported), and hide any message just for yourself. Hiding a message you received does not delete it, so it is still there if you report it. With Nowly Plus you can also edit a written message within 15 minutes of sending it, delete it for everyone for up to 24 hours, and hide «seen». When you edit a message, or delete one for everyone, the other person sees only that it was edited or deleted, but we keep the earlier written text with the message (until it goes, seven days after sending) so that a report can be judged on what was really written. It is never shown in the app; it is read only to review a report or to answer a lawful order. If the message, or you, are reported, that text is kept with the report, as the Privacy Policy states.

تختفي الرسائل والرسائل الصوتية بعد سبعة أيام، وصور المحادثة بعد 24 ساعة. وصور المحادثة من الكاميرا أو صورة واحدة تختارها بمنتقي الصور في جوالك، وتُفحص على جوالك كأي صورة أخرى. ويمكنك حذف رسالة عند الجميع خلال 15 دقيقة من إرسالها (ما لم تكن هدية، ولم يُبلَّغ عنها)، وإخفاء أي رسالة عندك وحدك. وإخفاء رسالة وصلتك لا يحذفها، فتبقى موجودة إن أبلغت عنها. ومع ناولي بلس تستطيع أيضًا تعديل رسالة مكتوبة خلال 15 دقيقة من إرسالها، وحذفها عند الجميع حتى 24 ساعة، وإخفاء «شوهد». وحين تعدّل رسالة أو تحذف واحدة عند الجميع، لا يرى الطرف الآخر إلا أنها عُدّلت أو حُذفت، لكننا نحتفظ بالنص المكتوب قبل ذلك مع الرسالة (إلى أن تزول بعد سبعة أيام من إرسالها) ليُحكم على البلاغ بما كُتب فعلًا. ولا يُعرض في التطبيق أبدًا؛ ولا يُقرأ إلا لمراجعة بلاغ أو للرد على أمر قانوني. وإن بُلِّغ عن الرسالة أو عنك، حُفظ هذا النص مع البلاغ كما تنص سياسة الخصوصية.

Where it is available, a camera photo in a chat can be sent as view-once. Only the person it was sent to can open it, and only once: it is shown for 3, 5 or 10 seconds, or until they close it, and it is then deleted from our storage. If it is never opened it is deleted after 24 hours like any chat photo, unless it is held for a report. Nowly tries to block screenshots while it is shown, but no app can fully prevent a screenshot or a photo of the screen taken with another device, so send only what you are comfortable sharing.

وحيث تتوافر الميزة، يمكن إرسال صورة كاميرا في المحادثة لتُعرض مرة واحدة. ولا يفتحها إلا من أُرسلت إليه، ومرة واحدة فقط: تظهر 3 أو 5 أو 10 ثوانٍ، أو حتى يغلقها، ثم تُحذف من تخزيننا. وإن لم تُفتح قط تُحذف بعد 24 ساعة كأي صورة محادثة، ما لم تكن ممسوكة لبلاغ. ويحاول Nowly منع لقطة الشاشة أثناء عرضها، لكن لا يستطيع أي تطبيق منع لقطة الشاشة أو تصوير الشاشة بجهاز آخر منعًا تامًّا، فلا ترسل إلا ما ترضى بمشاركته.

6. Reporting, and what we do about it

Every post carries a report action, in a lobby you can report anyone by tapping their name (see section 12), and you can block anyone at any time. Blocking is immediate and works both ways: neither of you will see the other, and any follow between you is removed.

We review every report and act within 24 hours. Depending on what we find, we will remove the content, pause or remove the account, or dismiss the report. Child exploitation is reported to the competent authorities.

• Hidden before review. A report of child exploitation or harm, or of intimate images without consent, hides the content at once, on the first report. Reports of nudity, violence or hate hide it after three different people report it, harassment after five, anything else after ten. Hidden is not deleted: a person decides

• False reports. Reporting is for real problems. Someone whose child-safety reports keep turning out false cannot report for a while

• Refused photos. A photo the check on your phone refuses never leaves it. Refusals within 30 days add up: a notice, then a reminder, then posting paused for 24 hours, then for 7 days, then the account is locked for review

• Appeals. If your account is paused or locked, or we removed something of yours, you can ask for a review from the app and a person looks at it again. If the check was wrong, the step is taken off your record. There is no appeal against a ban for child exploitation

• Lobby decisions are the lobby's. When a lobby's Owner or Admins remove, ban, mute or take someone off the mic in their own lobby, that is their call and there is no appeal to Nowly about it. Your account is not affected and you can enter any other lobby. Results worked out by fixed rules — contests, prizes, ranks, levels — are not appealed either; if you think something is broken, tell us from Settings

7. Your content stays yours

7. محتواك يبقى ملكك

You own what you post. By posting, you give us a worldwide, non-exclusive, royalty-free licence to host, store, copy (for example resized or reformatted for display), show and transmit your content, and to review it for safety, only to run Nowly and only for as long as the post exists — 4 hours, up to 24 if a VIP member chose it, or longer if you save it to your profile. Our hosting providers may do this on our behalf, and nothing more. If the moment is public, you also let us use a copy of it as the cover of that place in lobbies and on the place's page until a newer public moment from the place replaces it. That licence ends when the post and any cover copy do, or when you delete your account, except for copies that remain in backups until they expire and content we must keep for a report or for the authorities, as the Privacy Policy states. You confirm that you own what you post or have the right to post it, and that it does not infringe anyone's rights.

We do not use your photos in advertising, and we do not license them to anyone.

If you send us feedback or a suggestion, we may use it freely, without payment or credit to you.

وإن أرسلت لنا ملاحظة أو اقتراحًا، جاز لنا الانتفاع به بحرية، دون مقابل أو نسبة إليك.

Copyright and other rights. If you believe something in Nowly infringes your copyright or other rights, write to support@nowlyapp.com with what it is, where it is and why the right is yours. We review it and remove content where appropriate, and we may end the accounts of people who repeatedly infringe.

8. Levels and VIP

VIP and your level are not a subscription: Nowly Plus is the only subscription, and it is optional (section 10A). Your level and your VIP tier are earned, never sold. Everything in Nowly works without buying anything.

• Levels. Your level goes from 1 to 100. It grows with what you do on Nowly — being here, listening, talking on a mic, posting moments, hearts and gifts — and with the gold coins you spend. A level is permanent

• VIP. There are ten VIP tiers. You reach a tier when the gold coins you paid for and spent over the past 365 days reach its threshold. Each tier lasts a period — 30 days for VIP 1 to 3, 60 days for VIP 4 to 6, 90 days for VIP 7 to 10 — and you keep it by spending its keep amount within that period; otherwise, after 7 days' grace, you step down one tier (from VIP 1 to no VIP). The thresholds and keep amounts are published in the app

• What counts. Only gold coins you paid for, and then spend, count. Buying a pack does not raise anything by itself. Free gold coins — the daily ones, most alliance rewards and compensation — pack bonuses and what reaches you from gifts (Jewels) do not count. The one exception is the part of an alliance reward that comes from gold coins you paid for and spent in your own alliance that week (section 9). The 1,500 gold coins that come with each paid month of Nowly Plus (section 10A) count as paid coins.

Cosmetic touches (an entrance frame when you enter a lobby, your name in silver or rose gold, and gold from VIP 4), choosing how long each of your moments lasts, entering location lobbies from anywhere, discounts on the professional lobby plan (from VIP 4), and up to 100 pinned photos (everyone else: 3). The app lists each tier's touches

Levels and VIP never move your moments higher in anyone's feed or the trend, and never exempt you from these terms. The location rules and every other rule apply to VIP members exactly as they do to everyone else; the only difference is that a VIP member chooses how long each moment lasts — 4, 6, 12 or 24 hours — while everyone else's moments last 4 hours. An account with the Verified star also has up to 100 pinned photos, and shows the star only, never both marks (section 10).

9. No ads; contests and prizes

9. لا إعلانات؛ والمنافسات والجوائز

Nowly shows no ads, and there are no business accounts or offers in the app. If that changes, we will update these terms before it launches.

لا يعرض Nowly أي إعلانات، ولا توجد في التطبيق حسابات تجارية ولا عروض. وإن تغيّر ذلك، فسنحدّث هذه الشروط قبل إطلاقه.

Nowly runs a few contests for fun and pride: Face-off (one lobby against another, with playful throws that land on the other side's square, never on a person), the lobby league, alliances with weekly goals and a top three every Sunday, «top of the week» and the lobby's king of hearts. They all follow the same rules:

• Taking part is free, and you never have to buy anything to take part

• Rules are fixed and published in the app — no chance, no betting, no stakes and no cash

• Prizes are honorary titles, frames and badges for a set time, or free gold coins: alliance rewards and the Sunday give-back (5%, 3% and 2% of the week's spend for the top three, with a cap per person) are free gold coins. Most of them last 14 days and don't count towards a level or VIP; the part that comes from gold coins you paid for and spent in your own alliance that week (the give-back's share of what you paid and, for a weekly goal, up to what you paid there that week) lasts 30 days and counts towards VIP when you spend it, and a refund of the purchase behind it takes that back. The month's cup and the league's crowning are honour only
• Starting your own alliance is optional and costs 1,000 gold coins, once; joining one is free. An alliance has up to 30 members, its name and crest are visible to everyone in the app, and you can join a different alliance once every 7 days

10. Gold coins and digital items

10. القطع الذهبية والمقتنيات الرقمية

Gold coins, digital items, gifts, profile themes and name items are covered by Gold coins & In-App Purchases, which forms part of these terms. Gold coins are bought only through Apple, are not money, cannot be cashed out, cannot buy physical goods, and never move moments or places higher in any feed or trend. Gifts do count, openly, towards the alliance, Face-off and lobby standings described in section 9. If you are 18 or over and request a refund from Apple, you consent to us providing Apple with information about your use of that purchase (such as consumption and account tenure) to help Apple decide the request. We never send this information to Apple for anyone under 18.

Jewels. When someone sends you a gift, 10% of its value reaches you as Jewels, a second balance beside your gold coins. Jewels cannot be bought, have no cash value and cannot be cashed out, sold, transferred or turned into gold coins, and they do not expire. You can spend them on anything sold for gold coins, paying in full with Jewels; spending them can raise your level but never counts towards VIP. If Apple refunds the purchase behind a gift, the Jewels it gave may be taken back.

The gold name comes with VIP 4 and above and is not sold. It is not a badge, it does not mean verified, and it says nothing about who you are. The Verified star next to a name is different. It goes to well-known people, and to accounts that have become very popular inside Nowly — there is no fixed number; the team looks at each case. Only the Nowly team grants or removes the star, with a recorded reason. It cannot be bought, and Nowly volunteers can only suggest someone for it (section 13). A verified account also has up to 100 pinned photos (section 8).

Apart from the star, the only badges are the ones you earn by using Nowly, and they show on your profile only. No badge can be earned by paying. The one exception is the small violet + beside the name of a Nowly Plus subscriber (section 10A): it only shows that the subscription is active, says nothing about who the person is, and disappears when the subscription ends.

10A. Nowly Plus subscription

10أ. اشتراك ناولي بلس

Nowly Plus is an optional, auto-renewing subscription, monthly or yearly, bought only through Apple. Its price and period are the ones shown in the Nowly Plus sheet, in your own currency, before you confirm. Nothing in these terms fixes a price.

ناولي بلس (Nowly Plus) اشتراك اختياري يتجدد تلقائيًا، شهريًا أو سنويًا، ويُشترى عبر Apple فقط. وسعره ومدته هما المعروضان في ورقة ناولي بلس، بعملتك، قبل أن تؤكد. ولا تحدّد هذه الشروط أي سعر.

• Automatic renewal. The subscription renews automatically at the end of each period (a month or a year) unless you cancel it at least 24 hours before the period ends.
• التجديد التلقائي. يتجدد الاشتراك تلقائيًا في نهاية كل فترة (شهر أو سنة) ما لم تُلغِه قبل 24 ساعة على الأقل من نهاية الفترة.
• Payment. It is charged to your Apple Account when you confirm the purchase, and again at each renewal.

• Managing and cancelling. You manage and cancel it in your App Store account settings, or from “Manage subscription” in the Nowly Plus sheet. Deleting your Nowly account does not cancel it.

• Every paid month adds 1,500 gold coins to your wallet; on the yearly plan they are added month by month, not all at once. These are ordinary gold coins as described in section 10: they count towards your level and VIP exactly like gold coins you pay for, and they are taken back, with that progress, if Apple refunds or revokes the payment. Gold coins are not cash: they have no cash value and cannot be cashed out or turned into money.

• There is no free trial. Your Plus settings, favourites and backgrounds stay saved in case you come back, and a mic you took directly stays yours until you step down (section 12).

• What it includes. The full visitors list (every visitor by name, with 90 days of history instead of 30) and a small violet + beside your name; incognito browsing, so your own visits to profiles are not recorded, and quiet entry, with no entrance banner when you come into a lobby; sitting straight on an empty mic without asking; lobby looks from the open collections, except the gold ones, and early access to new store sets; editing a message within 15 minutes, deleting it for everyone for up to 24 hours, and hiding «seen»; chat backgrounds, 10 pinned chats instead of 3 and voice notes of up to 2 minutes instead of 1; your stats; up to five favourite friends, with a quiet alert when one of them comes into an open public lobby (a friend who hides their activity, is under 18 or has blocked you is never reported, and a favourite is never told); and saving or posting a picture with the camera's colour filters other than the one free filter. Everything else in Nowly stays free.
• Profile visits. Without VIP or Nowly Plus, the visitors list shows how many people visited and roughly when, but not who; with VIP it shows the visitors who are not VIP themselves; with Nowly Plus it shows everyone. When you open a profile, its owner may see your visit according to their plan, unless you browse in incognito.

Nowly Plus never lets anyone see what privacy settings, blocks or the age protections for members aged 16 to 17 hide: profile visits of under-18s are never recorded or shown. Profile visits are kept for 30 days, or 90 days for a subscriber’s own profile.

These terms, together with Apple's Standard Licensed Application End User License Agreement, are the licence terms for the subscription. How Nowly Plus uses your data is explained in the Privacy Policy.

11. Going, Occasions and Events

«رايح» (Going) lets you share a plan to visit a place at a time. Only people you follow who also follow you can see it and join. A plan disappears three hours after its time.

Occasions and Events. The Nowly team publishes Occasions (a national day or a season, for one country or several) and Events (a concert, match or festival). They appear under «Happening now» on Home. Some are visible to everyone and some only to the countries they are for; joining an Occasion is free, a photo you post at a place can count for the Occasion as well, and the same rules as everywhere else apply. Nobody can buy a place in them.

12. Lobbies

12. اللوبي

A lobby is a live room with text chat and voice, opened by a person. Everything in section 3 applies to what you say on the mic and write in the chat.

اللوبي غرفة مباشرة فيها دردشة كتابية وصوت، يفتحها شخص. وكل ما ورد في البند 3 ينطبق على ما تقوله على المايك وما تكتبه في الدردشة.

• Three kinds. A public lobby can be entered from anywhere in the world. A private lobby needs its secret number. A location lobby is for people at the place — your location is checked when you enter, and the server compares it with the place's boundary; once inside you stay even if you move, and leaving and coming back checks it again. VIP members, Nowly volunteers and the place's regulars can enter a location lobby from anywhere, and a gift worth 10,000 gold coins or more sent there opens it to everyone for 10 minutes. Only a location lobby shows its place

• Your lobby. Anyone can open a lobby, free, under their own name. Each person has one lobby, and can switch it between public, private and location at any time without losing anything. Closing it keeps its name, look, plans, Admins and history until you open it again; deleting it permanently removes everything bought for it, and that cannot be undone

• Leaving the app. If you are on a mic seat when you switch to another app or lock your phone, your mic stays as you left it, and iPhone shows its microphone indicator while it is open. A card on the lock screen lets you mute it or leave. You keep hearing the lobby for up to one hour, and then Nowly leaves the lobby for you. Nowly uses no location in the background

• Voice stage. A lobby has eight mics, in one of two layouts the Owner or an Admin can switch between: the Majlis (up to ten seats) and the open Stage. A mic only turns on when its person accepts it, and nobody can turn on someone else's mic. Raise your hand to join the queue. Voice is live, and Nowly does not record or store lobby audio. Your microphone is used only while your mic is on. Whoever takes a mic directly with Nowly Plus stays on it until they step down themselves or a moderator takes them off, even if their subscription ends meanwhile; the subscription is checked only at the moment the mic is taken.

• Reports. A report about a lobby is reviewed using what Nowly keeps: the report itself, account details, and the written lobby messages kept with the report as evidence. Lobby audio is not recorded or stored, whether or not a report is filed. The Privacy Policy gives the full details

• Music in a lobby. Only the Owner and the Admins can play music, and only songs from the Files app on their own phone, into the lobby, live, from a mic; no one else can. Nowly supplies no music and does not upload, record or keep what is played, and nothing is stored on Nowly's servers: it goes out live from their phone, and the room shows only its title and artist. You are responsible for having the rights to what you play, so do not play anything you have no right to play. Anyone in the lobby can report the music («Song issue» under «Report the lobby»), and the Owner, an Admin or the Nowly team can stop it at any moment; every stop by someone other than the person playing is logged

• Lobby plans. An Owner can add mics for 30 days — ten mics for 1,000 gold coins — or take the professional plan for 2,900 gold coins for 30 days, which gives twelve mics on the open Stage (the Majlis seats at most ten). A plan is paid once in gold coins; it is not a subscription and ends unless renewed, and the lobby goes back to eight mics. VIP 4 and above pay less for the professional plan

• Text and photos. Lobby messages are visible to everyone present. You see messages from the moment you join, not before; lobby chat is kept up to 6 hours for moderation, then deleted. You can take back your own message within 5 minutes; the Owner and Admins can wipe a message, and the original is kept for review. Links are not allowed, the same message can't be sent twice in a row, nor more than one message a second, and each message is up to 300 characters. Lobby photos come from the camera or from one photo you pick with your phone's photo picker, are checked on your phone like any other photo, and go when the lobby closes or after 6 hours

• A lobby has its own look, separate from your profile theme, which its Owner and Admins can change. Your own themes stay yours permanently and are not lost when a lobby closes or is deleted

• Removals. Someone removed from a lobby is taken out of it at once and cannot come back until the term (10 minutes, an hour, a day or a week) ends or the Owner or an Admin pardons them; a ban lasts until it is lifted. If your account is banned or a lobby suspension is placed on it, you are taken out of any lobby you are in

Reporting in a lobby

In any lobby, whether or not an Admin is present, you can tap anyone's name to report them, with a reason: insults, harassment, impersonation, sharing private information, hate or extremism, sexual talk, threats or violence, spam or scam, child exploitation or harm, or something else.

• The report reaches the Nowly team under your name. The person you report is never told who reported them

• A copy of the reported person's last 30 messages in that lobby, plus 20 messages around the one reported for context, is kept with the report as evidence, even after the lobby's messages are deleted

• Nobody is banned from Nowly automatically. People review every report and decide

• An Owner or Admin can warn someone: three warnings within 24 hours take them off the mic for an hour, and five within a week remove them from that lobby for a day

13. Lobby roles and Nowly volunteers

Each role in a lobby has a written charter — its task, its permissions, its limits and what it must never do. Every action is logged.

• Member — anyone in a lobby. Follows these terms and the Community Guidelines, and can write, report and block

• Owner — the person whose lobby it is. Names up to ten Admins and removes them; removes people for 10 minutes, an hour, a day or a week, or bans them from the lobby, and pardons them (lifts a removal or a ban); runs the mics and the chat; changes the lobby's look; closes or deletes the lobby. Cannot act on Nowly volunteers or the team

• Admin — named by the Owner to help run that lobby only. Removes and bans troublemakers and runs the mics and the chat, at most 40 actions an hour. Cannot act on the Owner or another Admin, and the Owner can remove the role at any time

• Nowly volunteer — appointed by the Nowly team after accepting the charter, and marked with Nowly's team mark. Can enter public and location lobbies from anywhere, mute someone for 10 minutes in an emergency, wipe a message or wipe and report it, and their reports reach the team first — at most 20 actions an hour. Has no powers in private lobbies, cannot remove, ban or warn, and cannot act on another volunteer. Breaking the charter removes the role

• Nowly team — may enter any lobby, public or private, for safety and to check reports, and every entry is logged. Can mute or remove anyone, suspend someone from lobbies for 7 or 30 days, and appoint volunteers. A full ban from Nowly is decided by the owner of Nowly

• VIP protection. An Admin or a Nowly volunteer cannot mute a member of VIP 5 or above in a lobby, nor remove or ban one of VIP 7 or above; the Owner and the Nowly team always can. Admins and volunteers can still take any VIP off the mic, mute their seat, wipe a message or warn them, so VIP never shields anyone from these terms

14. The rules the app enforces

Some things are not policy but mechanics, enforced by the app itself:

• You cannot post a moment from your library. There is no such button. A chat or lobby photo can also be one photo you pick with your phone's photo picker, and it goes through the same check as a camera photo.
• لا يمكنك نشر لحظة من مكتبة صورك. فلا يوجد زرّ لذلك أصلًا. أمّا صورة المحادثة أو اللوبي فقد تكون صورة واحدة تختارها بمنتقي الصور في جوالك، وتمرّ بالفحص نفسه كصورة الكاميرا.
• You cannot post from outside the venue you checked into.
• لا يمكنك النشر من خارج المكان الذي سجّلت حضورك فيه.
• You cannot post a photo taken more than two minutes ago.
• لا يمكنك نشر صورة مضى على التقاطها أكثر من دقيقتين.
• Moments disappear 4 hours after you post them — or after the time a VIP member chooses for theirs (6, 12 or 24 hours) — and the photo is deleted from storage then, unless you pinned it to your profile or it is held for a report. The comments and likes go with it.
• تختفي اللحظات بعد 4 ساعات من نشرها، أو بعد المدة التي يختارها مشترك VIP للحظته (6 أو 12 أو 24 ساعة)، وتُحذف الصورة من التخزين حينها، ما لم تكن قد ثبّتها في ملفك الشخصي، أو أُمسكت لبلاغ. وتذهب التعليقات والإعجابات معها.
• A video story is recorded live with the camera, is 2 to 25 seconds long, and cannot be picked from your library or your files. You can share up to 10 video stories a day. It disappears after the same time (4 hours, or a VIP member's pick up to 24) with its poster, the comments and the likes, and cannot be saved to your profile. The reporting, blocking and removal rules in these terms apply to it as to a photo.
• يُسجَّل فيديو القصة حيًّا بالكاميرا، وطوله من ثانيتين إلى 25 ثانية، ولا يمكن اختياره من مكتبتك أو ملفاتك. ويمكنك نشر حتى 10 قصص فيديو في اليوم. ويختفي بعد المدة نفسها (4 ساعات، أو ما يختاره مشترك VIP حتى 24 ساعة) مع صورته وتعليقاته وإعجاباته، ولا يُحفظ في ملفك الشخصي. وتسري عليه قواعد البلاغ والحظر والإزالة في هذه الشروط كما تسري على الصورة.
• The camera's colour filters change colour and tone only, on your phone. You can preview all of them; one is free, and saving or posting a picture with any other needs Nowly Plus. A filter does not change what you may post: section 3 applies to the picture exactly as it comes out.
• فلاتر الألوان في الكاميرا تغيّر اللون والدرجة فقط، وعلى جوالك. وتستطيع معاينتها كلها؛ وواحد منها مجاني، وحفظ صورة بأي فلتر آخر أو نشرها يحتاج ناولي بلس. والفلتر لا يغيّر ما يجوز لك نشره: البند 3 يسري على الصورة كما تخرج بالضبط.
• You can post a limited number of moments from one place in 24 hours (5 for most accounts).
• يمكنك نشر عدد محدود من اللحظات من المكان الواحد خلال 24 ساعة (5 لأغلب الحسابات).
• A username starts with an English letter, then English letters and numbers, with dots or underscores in the middle, up to 30 characters. Usernames of 5 or more characters are free to choose. You can change your username once a month; buying a standout name is allowed at any time. A username can't look like a web address.
• يبدأ اسم المستخدم بحرف إنجليزي، ثم حروف إنجليزية وأرقام، مع نقطة أو شرطة سفلية في الوسط، حتى 30 حرفًا. والأسماء من 5 أحرف فأكثر تختارها مجانًا. ويمكنك تغيير اسم المستخدم مرّة واحدة في الشهر، ويجوز شراء اسمٍ مميّز في أي وقت. ولا يجوز أن يشبه اسم المستخدم عنوان موقع.
• Standout usernames — 1 to 4 characters, or one letter repeated — are sold only inside the app, with gold coins, and each is sold once. The purchase is final once you confirm it: Nowly does not refund it. They are never sold on the web or by anyone else, so ignore anyone who offers you one.
• الأسماء المميّزة — من حرف إلى أربعة أحرف، أو حرفٌ واحد مكرّر — تُباع داخل التطبيق فقط بالقطع الذهبية، وكل اسمٍ يُباع مرّة واحدة. والشراء نهائي بعد تأكيده: لا يستردّه Nowly. ولا تُباع على الويب ولا عن طريق أي أحد، فتجاهل من يعرض عليك أحدها.
• You can enter a location lobby only while you are at the place (unless you are VIP, a Nowly volunteer or one of its regulars), and you leave it when you leave the place.
• لا تدخل لوبي اللوكيشن إلا وأنت في المكان (ما لم تكن VIP أو متطوّعًا في Nowly أو من «أهل المكان»)، وتغادره حين تغادر المكان.
• You cannot use a username that belongs to a company, a known app, or an international, government or official body, or a look-alike of one. Only that organisation can, once it has verified itself.
• لا يمكنك استعمال اسم مستخدمٍ يخصّ شركة، أو تطبيقًا معروفًا، أو جهةً عالمية أو حكومية أو رسمية، ولا نسخةً مموّهةً منه. فالجهة نفسها وحدها تستعمله بعد توثيقها.
• By default only mutual friends can message you (you can allow Everyone in Settings). Messages and voice messages disappear after seven days, chat photos after 24 hours.
• افتراضيًا لا يراسلك إلا الأصدقاء المتبادلون (ولك أن تسمح لـ«الجميع» من الإعدادات). وتختفي الرسائل والرسائل الصوتية بعد سبعة أيام، وصور المحادثة بعد 24 ساعة.
• Every venue you post from is counted, so the app can tell when places get busy.

• You cannot include a link in anything you write.

Attempting to work around any of these — by modifying the app, spoofing your location, or automating it — will end your account.

أي محاولة للتحايل على أيٍّ من هذه القواعد — بتعديل التطبيق، أو تزييف موقعك، أو أتمتة استخدام التطبيق — تؤدي إلى إنهاء حسابك.

15. Ending your account

15. إنهاء حسابك

You can delete your account at any time from Settings. You confirm with a typed word and your password (or a very recent sign-in). Deletion is always accepted, takes effect at once and cannot be undone. Everything is deleted in one sweep: your profile, your moments, your messages, your lobby and your follows, and your gold coin and purchase history in Nowly; any unused gold coins and items you own are lost with it. Child-safety evidence, and any record made for the authorities in a child-safety case, stays without your name for the time set out in the Privacy Policy (child-safety evidence is kept as long as needed for safety and legal purposes), and a minimal anonymous record of each purchase and refund is kept where and for as long as the law or accounting rules require. We may suspend or remove an account that breaks these terms, and for serious breaches we will do so without warning.

يمكنك حذف حسابك في أي وقت من الإعدادات. وتؤكّد بكلمة تكتبها وبكلمة مرورك (أو بتسجيل دخول حديث جدًّا). ويُقبل الحذف دائمًا، ويتمّ فورًا ولا يمكن التراجع عنه. ويُحذف كل شيء دفعة واحدة: ملفك الشخصي ولحظاتك ورسائلك ولوبيك ومتابعاتك وسجلّ قطعك الذهبية ومشترياتك في Nowly، وتضيع معه القطع الذهبية غير المستخدمة وكل المقتنيات التي تملكها. وتبقى أدلة سلامة الطفل، وأي سجلّ يُعدّ للجهات المختصّة في قضية سلامة طفل، بلا اسمك، للمدة المبيّنة في سياسة الخصوصية (وأدلة سلامة الأطفال تُحفظ بقدر ما يلزم لأغراض السلامة والأغراض القانونية)، ويُحفظ سجلّ مختصر مجهول الهوية لكل عملية شراء واسترداد حيث وما دام يوجب ذلك القانون أو قواعد المحاسبة. ويجوز لنا تعليق أي حساب يخالف هذه الشروط أو حذفه، وفي حالات المخالفة الجسيمة سنفعل ذلك دون إنذار.

16. Disclaimer and limitation of liability

In this section, "we" and "us" refer to the operator of Nowly, JAZIPLACE Software and Online Platforms, and "Nowly" refers to the app and everything in it. Read it together with the Privacy Policy, the Community Guidelines and Gold coins & In-App Purchases.

المقصود بـ«نحن» في هذا البند مشغّل Nowly، جازيبليس للبرمجيات والمنصات الإلكترونية، وبـ«Nowly» التطبيق وكل ما فيه. ويُقرأ مع سياسة الخصوصية وإرشادات المجتمع وصفحة القطع الذهبية والمشتريات داخل التطبيق.

In plain words: Nowly is a place where real people post, talk and meet. We build it with care and we moderate it, but we cannot control what people do, and we cannot promise that nothing will go wrong. Please read this section carefully, because it limits what you can claim from us.

بعبارة مبسّطة: Nowly مكان ينشر فيه أشخاص حقيقيون ويتحدثون ويلتقون. نبنيه بعناية ونشرف عليه، لكننا لا نملك التحكّم فيما يفعله الناس، ولا نستطيع أن نعد بألّا يقع خطأ. فنرجو أن تقرأ هذا البند بتمعّن، لأنه يحدّ ممّا يجوز لك المطالبة به منّا.

16.1 The service is provided "as is" and "as available"

Nowly is provided "as is" and "as available". To the fullest extent permitted by law, we give no warranty of any kind, express or implied, including any warranty of quality, fitness for a particular purpose, non-infringement, accuracy, availability, security, or that Nowly will be free of errors, interruptions or harmful components.

يُقدَّم Nowly «كما هو» و«حسب توافره». ونحن، إلى أقصى حدٍّ يجيزه القانون، لا نقدّم أي ضمان من أي نوع، صريحًا كان أو ضمنيًّا، ومن ذلك أي ضمان بشأن الجودة، أو الملاءمة لغرض معيّن، أو عدم التعدّي على حقوق الغير، أو الدقة، أو التوافر، أو الأمان، أو خلوّ Nowly من الأخطاء أو الانقطاعات أو العناصر الضارة.

We do not promise that Nowly, its moderation, its safety checks or its location checks will work perfectly, or that they will suit your device, your country or your needs. Features and availability differ from one country and one device to another.

Nothing in this section removes a right that the law of Bahrain, or a mandatory law that protects you where you live, does not allow to be removed.

16.2 User content, conduct and moderation

Everything people post, say, write or send in Nowly belongs to its author, and its author alone is responsible for it. That includes moments, stories, captions, comments, messages, voice, lobby names and rules, gift messages, usernames and profiles. What users say and show reflects their views, not ours.

كل ما ينشره الناس أو يقولونه أو يكتبونه أو يرسلونه في Nowly ملكٌ لصاحبه، وهو وحده المسؤول عنه. ويشمل ذلك اللحظات والقصص والنصوص المرافقة للصور والتعليقات والرسائل والصوت وأسماء اللوبيات وقواعدها ورسائل الهدايا وأسماء المستخدمين والملفات الشخصية. وما يقوله المستخدمون ويعرضونه يعبّر عن آرائهم، لا عن آرائنا.

We do not endorse, verify or guarantee any user, any content, any lobby, any alliance, or anything anyone claims. Levels, VIP, badges and the Verified star describe how someone uses Nowly or what the Nowly team decided; they do not mean that we vouch for the person, their statements or their conduct.

ونحن لا نزكّي ولا نتحقّق من ولا نضمن أي مستخدم، ولا أي محتوى، ولا أي لوبي، ولا أي تحالف، ولا أي ادّعاء يدّعيه أحد. والمستويات وVIP والشارات ونجمة «موثّق» تصف طريقة استخدام صاحبها Nowly أو قرارًا اتخذه فريق Nowly، ولا تعني أننا نكفل الشخص أو أقواله أو سلوكه.

Zero tolerance. There is no tolerance for objectionable content or abusive users in Nowly, as the Terms of Use and the Community Guidelines set out. Every post carries a report action, you can report anyone in a lobby by tapping their name, and you can block anyone at any time, from inside the app. Content that breaks the rules is removed, and the accounts behind it can be suspended or removed.

لا تسامح إطلاقًا. لا يُتسامح في Nowly مع المحتوى غير اللائق ولا مع المستخدمين المسيئين، كما تبيّن شروط الاستخدام وإرشادات المجتمع. ويتضمّن كل منشور خيارًا للإبلاغ، وتستطيع في اللوبي الإبلاغ عن أي شخص بالضغط على اسمه، وتستطيع حظر أي شخص في أي وقت، وذلك كله من داخل التطبيق. ويُحذف المحتوى المخالف، ويجوز تعليق الحسابات التي نشرته أو حذفها.

Our moderation is a best-effort measure, not a guarantee. We use checks on your phone, checks on our servers, reports, strikes and review by people. We review every report and act on it within 24 hours, as the Terms of Use state. Automated checks can miss things and can also refuse things by mistake. We do not monitor everything, and we are not obliged to. We do not promise any particular result for any person, that every breach will be found, or that content will never be seen before it is removed. We are not liable for content we did not remove, for the time it took, or for content we removed by mistake.

Lobbies are run by their Owners. An Owner, and the Admins the Owner names, are users, not our employees or agents. What they decide inside their own lobby is final, as the Terms of Use say, and we are not responsible for their rules, their decisions or their conduct. Nowly volunteers are unpaid, act only within their written charter, and are not our employees; we are not responsible for what they do outside it.

اللوبيات يديرها أصحابها. صاحب اللوبي (Owner) والمشرفون (Admins) الذين يعيّنهم مستخدمون، وليسوا موظفينا ولا وكلاءنا. وما يقرّرونه داخل لوبيهم نهائي، كما تنص شروط الاستخدام، ولسنا مسؤولين عن قواعدهم أو قراراتهم أو سلوكهم. ومتطوّعو Nowly يعملون دون أجر، وضمن ميثاقهم المكتوب وحده، وليسوا موظفين لدينا، ولسنا مسؤولين عمّا يفعلونه خارجه.

Alliances and Face-off («واجهني»). Alliances are groups made by users. Face-off and the other contests are for fun and pride: they follow fixed, published rules, involve no chance, betting or stake, and carry no prize of cash or monetary value. We are not liable for any result, rank, interruption, or dispute about them.

التحالفات و«واجهني» (Face-off). التحالفات مجموعات ينشئها المستخدمون. و«واجهني» وسائر المنافسات للمتعة والفخر: لها قواعد ثابتة منشورة، ولا حظّ فيها ولا رهان ولا مقابل، وليس فيها جائزة نقدية أو ذات قيمة مالية. ولا نتحمّل المسؤولية عن أي نتيجة أو ترتيب أو انقطاع أو نزاع بشأنها.

Copies are outside our control. Anything you show another person can be copied. A recipient, or another device, may capture a screen, photograph a screen, or save what they see. This includes view-once photos, disappearing messages, moments and stories: the limits we place on viewing reduce copying but cannot stop it, and we do not guarantee that content will not be saved or shared by others.

النسخ خارج سيطرتنا. كل ما تعرضه على شخص آخر يمكن نسخه. فقد يلتقط المتلقّي شاشته، أو يصوّرها بجهاز آخر، أو يحفظ ما يراه. ويشمل ذلك الصور التي تُعرض مرة واحدة، والرسائل التي تختفي، واللحظات والقصص: فالقيود التي نضعها على المشاهدة تقلّل النسخ ولا تمنعه، ولا نضمن ألّا يحفظ الآخرون المحتوى أو يشاركوه.

You are responsible for your own dealings with other users. A dispute between you and another user is between the two of you.

16.3 Real-world places and meeting people

Places, presence and activity shown in Nowly are informational only. The place name and "time since" on a moment, who is "busy" or "trending", «Locals», «Going» plans and similar signals come from what users post and from automated counts. They can be wrong, late, incomplete or out of date. They do not show that a person or an event is really at a place, or that a place is open, safe, lawful or suitable. A location check is a technical check of your phone's location; it can be inaccurate and it does not verify who anyone is.

Venue information comes from user posts, places added by users and third-party map data, and may be inaccurate. We have no relationship with venues unless we say so. A venue's name or image appearing in Nowly is not an endorsement of it by us, and does not mean that the venue endorses or is connected with Nowly.

معلومات الأماكن مصدرها منشورات المستخدمين والأماكن التي يضيفها المستخدمون وبيانات خرائط من طرف ثالث، وقد تكون غير دقيقة. ولا تربطنا بالأماكن علاقة ما لم نذكر خلاف ذلك. وظهور اسم مكان أو صورته في Nowly لا يعني تزكيتنا له، ولا يعني أن المكان يزكّي Nowly أو يرتبط به.

Meeting anyone in person is entirely at your own risk. We do not run background checks and we do not verify identities, and the Verified star is not a safety guarantee. We are not a party to any plan, meeting or outing, including «Going» plans and outings planned in chats. We are not responsible for what happens at or on the way to any venue or meeting, or for the conduct of any user, venue or third party, or for any injury, loss, harassment or damage resulting from them. Use your judgement as you would anywhere else: prefer public places, tell someone you trust where you are going, and leave if you feel uncomfortable.

لقاء أي شخص في الواقع على مسؤوليتك الكاملة. فنحن لا نجري فحصًا لسجلّ أحد، ولا نتحقّق من الهويات، ونجمة «موثّق» ليست ضمانًا للسلامة. ولسنا طرفًا في أي خطة أو لقاء أو خروج، ومنها خطط «رايح» والخروجات المخطّطة في المحادثات. ولسنا مسؤولين عمّا يحدث في أي مكان أو لقاء أو في الطريق إليه، ولا عن سلوك أي مستخدم أو مكان أو طرف ثالث، ولا عن أي إصابة أو خسارة أو تحرّش أو ضرر ينتج عن ذلك. فاحتكم إلى تقديرك كما تفعل في أي مكان آخر: فضّل الأماكن العامة، وأخبر شخصًا تثق به بوجهتك، وانصرف إن شعرت بعدم الارتياح.

Laws about photographing people and places differ between countries. You are responsible for following the law where you are, and for the photos you take and post.

وتختلف قوانين تصوير الأشخاص والأماكن من بلد إلى آخر. وأنت المسؤول عن التزام القانون في المكان الذي تكون فيه، وعن الصور التي تلتقطها وتنشرها.

Nowly is not an emergency service. In an emergency, call your local emergency number (999 in Bahrain).

16.4 Virtual items and gold coins

16.4 المقتنيات الرقمية والقطع الذهبية

A licence, not ownership. When you buy gold coins, or obtain any item, gift, theme, frame, wearable, hospitality item, entrance, lobby plan, username, level or VIP perk, you receive a limited, personal, revocable, non-exclusive and non-transferable licence to use it inside Nowly, for the period the app states (items described as permanent last for as long as your account is active and Nowly runs). You do not own it, and you gain no property right in it.

ترخيص وليس ملكية. حين تشتري قطعًا ذهبية، أو تحصل على أي مقتنى أو هدية أو طقم أو إطار أو ملبوس أو ضيافة أو دخلة أو خطة لوبي أو اسم مستخدم أو مستوى أو ميزة VIP، فإنك تحصل على ترخيص محدود شخصي قابل للإلغاء غير حصري وغير قابل للنقل لاستخدامه داخل Nowly، للمدة التي يذكرها التطبيق (وما وُصف بأنه دائم يبقى ما دام حسابك قائمًا وNowly يعمل). ولا تملكه، ولا ينشأ لك أي حق ملكية فيه.

Gold coins are a virtual currency inside Nowly, bought only through Apple's in-app purchase. They are licensed to you, not owned by you; they do not represent real-world money and have no cash value; they cannot be redeemed for money, cannot be sold, traded, lent or transferred to anyone for money (the only way to pass something to another person is to gift an item inside the app), and cannot be used outside Nowly or to buy physical goods. Gifts are digital and cosmetic: they have no cash value and cannot be cashed out. Jewels, the second balance that gifts give, are treated the same way. They are not money, a deposit, electronic money or stored value, and they earn no interest. Any attempt to sell or buy them or Nowly items outside the app is a breach of the Terms of Use, and anyone offering to do so does not act for us.

القطع الذهبية عملة افتراضية داخل Nowly، تُشترى عبر الشراء داخل التطبيق من Apple فقط. وهي مرخّصة لك لا مملوكة لك، ولا تمثّل نقودًا حقيقية، ولا قيمة نقدية لها، ولا تُصرف نقدًا، ولا يجوز بيعها أو مبادلتها أو إقراضها أو نقلها إلى أحد مقابل مال (والطريقة الوحيدة لتمرير شيء إلى شخص آخر هي إهداؤه مقتنى داخل التطبيق)، ولا تُستخدم خارج Nowly ولا تُشترى بها سلع مادية. والهدايا رقمية وشكلية، لا قيمة نقدية لها ولا تُصرف نقدًا. والجواهر، وهي الرصيد الثاني الذي تعطيه الهدايا، تُعامَل بالطريقة نفسها. وهي ليست نقودًا ولا وديعة ولا نقودًا إلكترونية ولا قيمة مخزّنة، ولا تُدرّ فائدة. وأي محاولة لبيعها أو شرائها، أو بيع مقتنيات Nowly أو شرائها، خارج التطبيق تخالف شروط الاستخدام، ومن يعرض ذلك عليك لا يتصرّف نيابةً عنّا.

We may change the offer. We may change, rebalance or withdraw items, packs, prices, thresholds and perks going forward, and we will tell you in the app before a change that affects you takes effect. Free gold coins expire as the app states.

يجوز لنا تعديل العرض. يجوز لنا أن نغيّر المقتنيات والباقات والأسعار والحدود والمزايا أو نعيد موازنتها أو نسحبها فيما يستقبل، ونخبرك داخل التطبيق قبل أن يسري تغيير يؤثّر فيك. وتنتهي القطع الذهبية المجانية بحسب ما يبيّنه التطبيق.

Purchases and refunds. Gold coins are bought only through Apple. What you buy with them is final once you confirm it, as Gold coins & In-App Purchases says, except where Apple's policies or applicable law provide otherwise. Billing, and any refund of an Apple purchase, are handled by Apple under Apple's own terms and policies and applicable law; nothing in this section limits any right you have against Apple. Test purchases made in Apple's Sandbox by App Review and testers are not real payments: on reviewer and tester accounts they become a free 7-day grant with no VIP level or XP, and on any other account they are refused. If Apple refunds or reverses a purchase, we may reverse the gold coins or items that purchase gave you, including by deducting them from your balance.

المشتريات والاسترداد. تُشترى القطع الذهبية عبر Apple فقط. وما تشتريه بها نهائي متى أكّدته، كما تبيّن صفحة القطع الذهبية والمشتريات داخل التطبيق، إلا حيث تقضي سياسات Apple أو القانون الواجب التطبيق بغير ذلك. وتتولى Apple الفوترة، وأي استرداد لمشترى من Apple، وفق شروطها وسياساتها والقانون الواجب التطبيق؛ ولا يحدّ هذا البند من أي حق لك قِبَل Apple. والمشتريات التجريبية في بيئة Sandbox لدى Apple التي يجريها مراجعو التطبيق والمختبِرون ليست دفعًا حقيقيًّا: ففي حسابات المراجعة والاختبار تصير منحة مجانية مدتها 7 أيام بلا مستوى VIP ولا نقاط خبرة، وفي أي حساب آخر تُرفض. وإن ردّت Apple ثمن مشترى أو عكسته، جاز لنا عكس ما منحك ذلك المشترى من قطع ذهبية أو مقتنيات، ومن ذلك خصمها من رصيدك.

If your account ends. If your account is suspended or removed for breaking the rules, or you delete it, unused gold coins and everything you own end with it, without compensation.

إن انتهى حسابك. إن عُلّق حسابك أو حُذف لمخالفة القواعد، أو حذفته أنت، فإن القطع الذهبية غير المستخدمة وكل ما تملكه من مقتنيات تنتهي معه دون تعويض.

Your account, your purchases. You are responsible for purchases made through your account and your Apple Account, including by family members who use them. If an error in our systems affects your gold coins balance, tell us at support@nowlyapp.com and we will review it.

حسابك ومشترياتك. أنت المسؤول عن المشتريات التي تتم من خلال حسابك وحساب Apple الخاص بك، ومنها ما يجريه أفراد العائلة ممن يستخدمونهما. وإن أثّر خطأ في أنظمتنا في رصيدك من القطع الذهبية، فأخبرنا على support@nowlyapp.com وسنراجع الأمر.

16.5 Live audio

Lobby voice is live and is relayed to the people in the lobby. Nowly does not record or store lobby audio, whether or not someone files a report.

• A report about a lobby is reviewed using what we do keep: the report itself, account details, and the written lobby messages kept with the report as evidence, as the Privacy Policy explains.
• يُراجَع البلاغ عن لوبي بما نحتفظ به فعلًا: البلاغ نفسه، وبيانات الحسابات، ورسائل اللوبي المكتوبة المحفوظة مع البلاغ دليلًا، كما توضح سياسة الخصوصية.
• Other people in a lobby, or their devices or software, can record it, and we cannot prevent that. We are not responsible for recordings made by users.
• قد يسجّل اللوبي أشخاص آخرون فيه أو أجهزتهم أو برامجهم، ولا نملك منع ذلك. ولسنا مسؤولين عن التسجيلات التي يجريها المستخدمون.
• A voice message you send in a chat is kept for seven days, and a reported one is held for review for the period stated in the Privacy Policy. Your microphone is used only while your mic is on. The people present may also include members of the Nowly team entering for safety, as the Privacy Policy explains.
• الرسالة الصوتية التي ترسلها في محادثة تُحفظ سبعة أيام، وتُمسك المُبلَّغ عنها للمراجعة المدة المذكورة في سياسة الخصوصية. ولا يُستخدم ميكروفونك إلا ومايكك مفتوح. وقد يكون من بين الحاضرين أفراد من فريق Nowly يدخلون للسلامة، كما توضح سياسة الخصوصية.
• We cannot provide lobby audio to anyone, including in response to a lawful request, because we do not hold it.
• لا نستطيع تسليم صوت اللوبي لأي جهة، ولا استجابةً لطلب مشروع، لأننا لا نحتفظ به.

You must not record, capture, transcribe, stream or share another person's voice, messages or screen without that person's consent, or where the law forbids it. If you do, you alone are responsible.

ولا يجوز لك تسجيل صوت شخص آخر أو رسائله أو شاشته، ولا التقاطها أو تفريغها أو بثّها أو مشاركتها، دون موافقته، أو حيث يحظر القانون ذلك. فإن فعلت فأنت وحدك المسؤول.

We are not liable for what users say, on the mic or in writing, or for the effect it has on others. Live speech cannot be reviewed before it is heard. We are not liable for audio quality, delay, echo or dropped connections, which depend on your device, your network and our providers.

ولسنا مسؤولين عمّا يقوله المستخدمون، على المايك أو كتابةً، ولا عن أثره في غيرهم. فالكلام المباشر لا يمكن مراجعته قبل سماعه. ولسنا مسؤولين عن جودة الصوت أو تأخّره أو صداه أو انقطاع الاتصال، فهي تتوقف على جهازك وشبكتك ومزوّدينا.

16.6 Third-party services

Nowly relies on services we do not own or control, including Apple (the App Store, payments, Family Sharing and Ask to Buy, and the map search on your phone), our hosting and network provider (which also relays live lobby voice), our email provider and, where a feature uses one, a third-party AI provider. Their own terms and policies apply to what they provide.

يعتمد Nowly على خدمات لا نملكها ولا نتحكّم بها، منها Apple (المتجر والمدفوعات و«مشاركة العائلة» و«طلب الشراء» والبحث في الخرائط على جوالك)، ومزوّد الاستضافة والشبكة لدينا (وهو يمرّر أيضًا صوت اللوبي المباشر)، ومزوّد البريد، ومزوّد ذكاء اصطناعي من طرف ثالث حيث تستخدم ميزةٌ مزوّدًا كهذا. وتسري شروط هؤلاء وسياساتهم على ما يقدّمونه.

We are not responsible for them: for their errors, outages, delays, security, prices, decisions or policies (including Apple's decisions about billing, refunds or your Apple Account), nor for your mobile carrier or internet connection, or any data charges you incur.

ولسنا مسؤولين عنهم: لا عن أخطائهم ولا انقطاعاتهم ولا تأخّرهم ولا أمنهم ولا أسعارهم ولا قراراتهم ولا سياساتهم (ومنها قرارات Apple بشأن الفوترة أو الاسترداد أو حساب Apple الخاص بك)، ولا عن مشغّل اتصالاتك أو اتصالك بالإنترنت، ولا عن أي رسوم بيانات تتحمّلها.

16.7 AI outputs

No feature of Nowly currently sends your personal data to a third-party AI provider. Our team may use AI-assisted tools to compile public information about events and places, and a future feature may use automated systems or an AI provider, for example to help draft, summarise or suggest. AI outputs may be inaccurate, incomplete, out of date, offensive or unsuitable. They are not professional advice of any kind (medical, legal, financial, religious, safety or otherwise). Check anything important with a qualified person or the original source before relying on it, and confirm event details with the organiser. What is sent to an AI provider is limited to what the Privacy Policy states. We are not liable for loss caused by relying on an AI output.

لا ترسل أي ميزة في Nowly حاليًّا بياناتك الشخصية إلى مزوّد ذكاء اصطناعي من طرف ثالث. وقد يستخدم فريقنا أدوات بمساعدة الذكاء الاصطناعي لتجميع معلومات عامة عن الفعاليات والأماكن، وقد تستخدم ميزة مستقبلية أنظمة آلية أو مزوّد ذكاء اصطناعي، مثل المساعدة في الصياغة أو التلخيص أو الاقتراح. وقد تكون مخرجات الذكاء الاصطناعي غير دقيقة أو ناقصة أو قديمة أو مسيئة أو غير مناسبة. وليست نصيحة مهنية من أي نوع (طبية أو قانونية أو مالية أو دينية أو أمنية أو غيرها). فتحقّق من كل أمر مهم عند مختص مؤهّل أو من المصدر الأصلي قبل الاعتماد عليه، وتأكّد من تفاصيل الفعالية لدى منظّمها. وما يُرسل إلى مزوّد الذكاء الاصطناعي محصور في ما تبيّنه سياسة الخصوصية. ولا نتحمّل مسؤولية أي خسارة ناتجة عن الاعتماد على مخرجات الذكاء الاصطناعي.

16.8 Limitation of liability

To the fullest extent permitted by applicable law, including the law of the Kingdom of Bahrain:

إلى أقصى حدٍّ يجيزه القانون الواجب التطبيق، ومنه قانون مملكة البحرين:

(a) No indirect loss. JAZIPLACE, its owners, partners, officers, employees, volunteers, contractors, licensors and affiliates ("the Nowly parties") are not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for loss of profit, income, data, goodwill or opportunity, arising from or related to Nowly or your use of it, or inability to use it, whether in contract, tort (including negligence) or otherwise, even if we were told it might happen.

(أ) لا تعويض عن الضرر غير المباشر. لا تتحمّل جازيبليس ولا ملّاكها وشركاؤها ومديروها وموظفوها ومتطوّعوها ومتعاقدوها ومرخّصوها وشركاتها التابعة («أطراف Nowly») المسؤولية عن أي خسارة أو ضرر غير مباشر أو عرضي أو خاص أو تبعي أو تأديبي أو تحذيري، ولا عن فوات الربح أو الدخل أو ضياع البيانات أو السمعة أو الفرصة، الناشئ عن Nowly أو المتصل به أو عن استخدامك له أو عجزك عن استخدامه، سواء في العقد أو المسؤولية التقصيرية (ومنها الإهمال) أو غيرهما، ولو أُخبرنا باحتمال وقوعه.

(b) Cap. The total liability of the Nowly parties to you for all claims related to Nowly will not exceed the greater of (a) BHD 10 (ten Bahraini dinars) and (b) the total amount you paid for gold coins and other paid items in Nowly in the 12 months before the claim arose.

(ب) السقف. لا يتجاوز إجمالي مسؤولية أطراف Nowly تجاهك عن جميع المطالبات المتصلة بـNowly الأكبرَ من: (أ) 10 دنانير بحرينية (عشرة دنانير بحرينية)، و(ب) مجموع ما دفعته مقابل القطع الذهبية والمقتنيات المدفوعة في Nowly خلال الأشهر الاثني عشر السابقة لنشوء المطالبة.

(c) What is not limited. Nothing in this section excludes or limits liability for death or personal injury caused by negligence, for fraud, for intentional wrongdoing or gross negligence, or any other liability that cannot be excluded or limited by applicable law. Where the law does not allow part of this section, that part applies only to the extent the law allows.

(ج) ما لا يُحدَّد. لا يستبعد هذا البند ولا يحدّ من المسؤولية عن الوفاة أو الإصابة الجسدية الناتجة عن الإهمال، ولا عن الغش، ولا عن الخطأ العمد أو الجسيم، ولا من أي مسؤولية أخرى لا يجيز القانون الواجب التطبيق استبعادها أو تحديدها. وإن كان القانون لا يجيز جزءًا من هذا البند، سرى ذلك الجزء في الحدود التي يجيزها القانون فقط.

(d) Other users. To the extent permitted by law, you release the Nowly parties from claims and damages arising from disputes with, or the conduct of, other users, lobby Owners and Admins.

(د) المستخدمون الآخرون. وفي الحدود التي يجيزها القانون، تُبرئ أطراف Nowly من المطالبات والأضرار الناشئة عن خلافاتك مع المستخدمين الآخرين وأصحاب اللوبيات ومشرفيها أو عن سلوكهم.

These limits apply to all claims together, not per claim, and they are part of the basis on which Nowly is offered.

وتسري هذه الحدود على جميع المطالبات مجتمعةً لا على كل مطالبة على حدة، وهي جزء من الأساس الذي يُعرض عليه Nowly.

16.9 Indemnification

16.9 التعويض

You agree to compensate and hold harmless the Nowly parties from any claim, loss, liability, damage or cost (including reasonable legal fees) brought by a third party or arising from: (a) your content; (b) your breach of the Terms of Use, the Community Guidelines or the law; (c) your violation of another person's rights, including their privacy, image or intellectual property, and including recording or sharing another person's voice, messages or images without consent; (d) your dealings or meetings with other users; or (e) misuse of your account. If you are under 18, then to the extent the law permits, the parent or guardian who agreed to your use of Nowly shares this responsibility. We will tell you of a claim promptly and you will cooperate reasonably. This clause does not apply where the law forbids it.

توافق على أن تعوّض أطراف Nowly وتبرئها من أي مطالبة أو خسارة أو مسؤولية أو ضرر أو تكلفة (ومنها أتعاب المحاماة المعقولة) يرفعها طرف ثالث أو تنشأ عن: (أ) محتواك؛ (ب) مخالفتك شروط الاستخدام أو إرشادات المجتمع أو القانون؛ (ج) انتهاكك حقوق شخص آخر، ومنها خصوصيته وصورته وملكيته الفكرية، ومنه تسجيل صوت شخص آخر أو رسائله أو صوره أو مشاركتها دون موافقته؛ (د) تعاملاتك أو لقاءاتك مع مستخدمين آخرين؛ (هـ) إساءة استخدام حسابك. وإن كان عمرك دون 18 عامًا، فإن وليّ أمرك الذي وافق على استخدامك Nowly يشاركك هذه المسؤولية بالقدر الذي يجيزه القانون. وسنخطرك بالمطالبة فور علمنا بها، وتتعاون معنا تعاونًا معقولًا. ولا يسري هذا البند حيث يحظره القانون.

16.10 Service changes, interruptions and data loss

16.10 تغيّر الخدمة وانقطاعها وفقد البيانات

We may change, limit, suspend or end any feature, or Nowly itself, for a time or permanently. Where a change materially affects you, we will tell you in the app first where we reasonably can. Nowly may be unavailable for maintenance, updates, faults, attacks or failures of third parties, and older versions of the app may stop working until you update. Nowly is not offered in the European Economic Area (the 27 EU member states, Norway, Iceland and Liechtenstein), and some features may not be offered elsewhere; using Nowly where it is not offered or where it is unlawful is at your own risk.

يجوز لنا تغيير أي ميزة، أو تقييدها، أو إيقافها، أو إنهاؤها، أو إنهاء Nowly نفسه، مؤقتًا أو دائمًا. وحين يؤثّر التغيير فيك تأثيرًا جوهريًّا فسنُعلمك داخل التطبيق أوّلًا متى أمكننا ذلك بصورة معقولة. وقد يتعذّر Nowly بسبب الصيانة أو التحديثات أو الأعطال أو الهجمات أو إخفاق أطراف ثالثة، وقد تتوقف النسخ القديمة من التطبيق عن العمل حتى تحدّثها. ولا يُتاح Nowly في المنطقة الاقتصادية الأوروبية (الدول الأعضاء السبع والعشرون في الاتحاد الأوروبي والنرويج وآيسلندا وليختنشتاين)، وقد لا تُتاح بعض الميزات في أماكن أخرى؛ واستخدام Nowly حيث لا يُتاح أو حيث يخالف القانون على مسؤوليتك.

Content in Nowly is temporary by design: moments last 4 hours (up to 24 for VIP members, as they choose) and chat photos 24 hours, messages seven days, lobby chat a few hours, and lobby photos until the lobby closes or six hours, as the Terms of Use and the Privacy Policy state. We are not liable for the loss, deletion or corruption of content, messages, items or gold coins, whether from faults, outages, moderation, closing or deleting a lobby, or ending an account, except where the law requires. Keep your own copy of anything you cannot afford to lose. If we discontinue Nowly, we will give reasonable advance notice in the app, so that you can use your gold coins, subject to applicable law.

والمحتوى في Nowly مؤقت بطبيعته: فاللحظات تدوم 4 ساعات (وحتى 24 ساعة لمشتركي VIP حسب اختيارهم)، وصور المحادثة 24 ساعة، والرسائل سبعة أيام، ودردشة اللوبي ساعات معدودة، وصور اللوبي حتى إغلاقه أو ست ساعات، كما تبيّن شروط الاستخدام وسياسة الخصوصية. ولسنا مسؤولين عن ضياع المحتوى أو الرسائل أو المقتنيات أو القطع الذهبية أو حذفها أو تلفها، سواء بسبب أعطال أو انقطاعات أو إشراف أو إغلاق لوبي أو حذفه أو إنهاء حساب، إلا حيث يوجب القانون خلاف ذلك. فاحتفظ بنسخة خاصة بما لا تحتمل ضياعه. وإن أوقفنا Nowly فسنمنحك مهلة معقولة مسبقة داخل التطبيق لتتمكن من استخدام قطعك الذهبية، مع مراعاة القانون الواجب التطبيق.

16.11 Suspension and termination

We may warn you, restrict, suspend or end your account or any feature (including posting, the mic, lobbies or gifting), with or without notice, if you break the Terms of Use or the Community Guidelines, if the law or safety requires it, if we suspect fraud or abuse, or if you try to get around the rules (for example by modifying the app or spoofing your location). Serious breaches may be dealt with without warning, and child exploitation is reported to the competent authorities.

يجوز لنا تنبيهك، أو تقييد حسابك أو أي ميزة فيه (ومنها النشر والمايك واللوبيات والإهداء)، أو تعليقه أو إنهاؤه، بإخطار أو دونه، إن خالفت شروط الاستخدام أو إرشادات المجتمع، أو أوجب القانون أو السلامة ذلك، أو اشتبهنا في احتيال أو إساءة، أو حاولت التحايل على القواعد (كتعديل التطبيق أو تزييف موقعك). وقد نتعامل مع المخالفات الجسيمة دون إنذار، ويُبلَّغ عن استغلال الأطفال إلى الجهات المختصة.

When an account is suspended or removed for a breach, unused gold coins and items are lost without compensation (to the extent permitted by applicable law), and content may be removed or held as the Privacy Policy states. You may ask for a review as the Terms of Use describe, except where they say there is no appeal.

وعند تعليق حساب أو حذفه بسبب مخالفة، تضيع القطع الذهبية والمقتنيات غير المستخدمة دون تعويض (في الحدود التي يجيزها القانون الواجب التطبيق)، وقد يُحذف المحتوى أو يُمسك كما تبيّن سياسة الخصوصية. ويجوز لك طلب المراجعة كما تصف شروط الاستخدام، إلا حيث تنص على أنه لا اعتراض.

Deleting your account. You can delete your account yourself at any time, from inside the app: Settings, then Delete account. You confirm with a typed word and your password (or a very recent sign-in). Deletion is always accepted, takes effect at once and cannot be undone. Everything is deleted in one sweep: your profile, moments, messages, lobby and follows and your gold coin and purchase history in Nowly, and your photos are erased from storage; unused gold coins and everything you have bought or own end with it, and are not refunded by us. The only things kept are child-safety evidence, without your name, for the time the Privacy Policy states (child-safety evidence is kept as long as needed for safety and legal purposes), and a minimal anonymous record of each purchase and refund, where and for as long as the law or accounting rules require. Apple keeps its own purchase records, and deleting your account does not cancel or refund any purchase already made with Apple. We are not liable for acting in good faith under this clause. Clauses that by their nature should continue after an account ends, including this section, continue.

حذف حسابك. تستطيع حذف حسابك بنفسك في أي وقت من داخل التطبيق: الإعدادات، ثم «حذف الحساب». وتؤكّد بكلمة تكتبها وبكلمة مرورك (أو بتسجيل دخول حديث جدًّا). ويُقبل الحذف دائمًا، ويتمّ فورًا ولا يمكن التراجع عنه. ويُحذف كل شيء دفعة واحدة: ملفك الشخصي ولحظاتك ورسائلك ولوبيك ومتابعاتك وسجلّ قطعك الذهبية ومشترياتك في Nowly، وتُمحى صورك من التخزين؛ وتنتهي معه القطع الذهبية غير المستخدمة وكل ما اشتريته أو تملكه، ولا نردّ قيمتها. ولا يبقى إلا أدلة سلامة الطفل، بلا اسمك، للمدة التي تبيّنها سياسة الخصوصية (وأدلة سلامة الأطفال تُحفظ بقدر ما يلزم لأغراض السلامة والأغراض القانونية)، وسجلّ مختصر مجهول الهوية لكل عملية شراء واسترداد حيث وما دام يوجب ذلك القانون أو قواعد المحاسبة. وتحتفظ Apple بسجلات مشترياتها، ولا يلغي حذف الحساب أي مشترى سبق إجراؤه عبر Apple ولا يستردّه. ولا نتحمّل المسؤولية عن تصرّف بحسن نية وفق هذا البند. وتبقى سارية، بعد انتهاء الحساب، البنود التي تقتضي طبيعتها استمرارها، ومنها هذا البند.

16.12 Force majeure

We are not liable for any failure or delay in providing Nowly caused by an event beyond our reasonable control, including natural disaster, fire, flood, epidemic, war, hostilities, terrorism, civil unrest, strike, a government or regulatory act or order (including a block or restriction on the internet, apps or telecommunications, or a change in law), power or telecommunications failure, cyber attack, or a failure of a third-party provider such as Apple or our hosting provider. Our obligations are suspended while the event lasts.

لا نتحمّل المسؤولية عن أي إخفاق أو تأخّر في تقديم Nowly سببه حدث خارج عن سيطرتنا المعقولة، ومنه الكارثة الطبيعية، والحريق، والفيضان، والوباء، والحرب، والأعمال العدائية، والإرهاب، والاضطرابات المدنية، والإضراب، وأي عمل أو أمر حكومي أو تنظيمي (ومنه حجب الإنترنت أو التطبيقات أو الاتصالات أو تقييدها، وتغيّر القانون)، وانقطاع الكهرباء أو الاتصالات، والهجمات الإلكترونية، وإخفاق مزوّد من الأطراف الثالثة كـApple أو مزوّد الاستضافة لدينا. وتُعلَّق التزاماتنا طوال مدة الحدث.

16.13 Governing law and courts

16.13 القانون الواجب التطبيق والمحاكم

These terms are governed by the laws of the Kingdom of Bahrain, without regard to conflict-of-law rules, and the courts of the Kingdom of Bahrain have jurisdiction over any dispute. This is without prejudice to any mandatory consumer protections that apply to you in your country of residence. Before starting a claim, please write to support@nowlyapp.com so that we can try to resolve it; we will respond within 30 days.

يخضع هذا البند وشروط الاستخدام لقوانين مملكة البحرين، دون اعتبار لقواعد تنازع القوانين، وتختص محاكم مملكة البحرين بالنظر في أي نزاع. وذلك دون إخلال بأي حماية آمرة للمستهلك تسري عليك في بلد إقامتك. وقبل رفع أي مطالبة نرجو أن تراسلنا على support@nowlyapp.com لنحاول حلّها، وسنردّ عليك خلال 30 يومًا.

16.14 Apple-specific terms

16.14 الأحكام الخاصة بـApple

These terms apply because Nowly is distributed through the Apple App Store. They are the minimum terms Apple requires of an end-user licence agreement, and they apply together with Apple's Standard Licensed Application End User License Agreement; if there is a conflict, the one that gives you more protection applies.

تسري هذه الأحكام لأن Nowly يُوزَّع عبر متجر Apple App Store. وهي الحد الأدنى الذي تشترطه Apple في اتفاقية ترخيص المستخدم النهائي، وتسري مع اتفاقية Apple القياسية لترخيص المستخدم النهائي للتطبيق المرخّص؛ وإن تعارضتا سرى الحكم الأكثر حمايةً لك.

1. Acknowledgement. These terms are an agreement between you and JAZIPLACE only, not between you and Apple. JAZIPLACE, not Apple, is solely responsible for Nowly and its content.

1. الإقرار. هذه الأحكام اتفاقية بينك وبين جازيبليس وحدها، لا بينك وبين Apple. وجازيبليس، لا Apple، هي المسؤولة وحدها عن Nowly ومحتواه.

2. Scope of licence. The licence we give you is a limited, non-transferable licence to use Nowly on Apple-branded devices that you own or control, as the Usage Rules in the App Store Terms of Service allow. It also allows use by other accounts connected to you through Family Sharing, as those rules allow.

2. نطاق الترخيص. الترخيص الذي نمنحك إيّاه ترخيص محدود غير قابل للنقل لاستخدام Nowly على أجهزة تحمل علامة Apple تملكها أو تتحكّم بها، وفق قواعد الاستخدام الواردة في شروط خدمة App Store. ويجيز كذلك الاستخدام من الحسابات المرتبطة بك عبر «مشاركة العائلة»، وفق تلك القواعد.

3. Maintenance and support. JAZIPLACE, not Apple, is solely responsible for maintenance and support of Nowly, as the Terms of Use and the support page describe. Apple has no obligation to provide any maintenance or support for Nowly.

3. الصيانة والدعم. جازيبليس، لا Apple، هي المسؤولة وحدها عن صيانة Nowly ودعمه، كما تصف شروط الاستخدام وصفحة الدعم. ولا تلتزم Apple بأي صيانة أو دعم لـNowly.

4. Warranty. If Nowly fails to conform to any warranty that applies to it, you may notify Apple, and Apple will refund the purchase price of the app, if any (Nowly itself is free). To the maximum extent permitted by applicable law, Apple has no other warranty obligation for Nowly, and any other claim, loss, liability, damage, cost or expense caused by a failure to conform to a warranty is, as between you and Apple, JAZIPLACE's responsibility.

4. الضمان. إن أخفق Nowly في مطابقة أي ضمان ينطبق عليه، فلك أن تُخطر Apple، وتردّ لك Apple ثمن شراء التطبيق إن وُجد (وNowly نفسه مجاني). وفي أقصى حدٍّ يجيزه القانون الواجب التطبيق، لا تلتزم Apple بأي ضمان آخر بشأن Nowly، وأي مطالبة أو خسارة أو مسؤولية أو ضرر أو تكلفة أو نفقة أخرى سببها الإخفاق في مطابقة ضمان تقع مسؤوليتها، في العلاقة بينك وبين Apple، على جازيبليس.

5. Product claims. JAZIPLACE, not Apple, is responsible for dealing with any claim you or anyone else has about Nowly or your use of it, including product liability claims, claims that Nowly fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

5. مطالبات المنتج. جازيبليس، لا Apple، هي المسؤولة عن معالجة أي مطالبة لك أو لغيرك بشأن Nowly أو استخدامك له، ومنها مطالبات مسؤولية المنتج، ومطالبات عدم استيفاء Nowly متطلبًا قانونيًّا أو تنظيميًّا، والمطالبات المبنية على قوانين حماية المستهلك أو الخصوصية أو ما يشبهها.

6. Intellectual property claims. If a third party claims that Nowly or your use of it infringes their intellectual property rights, JAZIPLACE, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.

6. مطالبات الملكية الفكرية. إن ادّعى طرف ثالث أن Nowly أو استخدامك له ينتهك حقوقه في الملكية الفكرية، فجازيبليس، لا Apple، هي المسؤولة وحدها عن التحقيق في المطالبة والدفاع عنها وتسويتها وإنهائها.

7. Legal compliance. You confirm that you are not located in a country that is subject to a US Government embargo, or that the US Government has designated a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.

7. الامتثال القانوني. تُقرّ بأنك لست في بلد تخضع لحظر من حكومة الولايات المتحدة أو صنّفته حكومة الولايات المتحدة «بلدًا داعمًا للإرهاب»، وبأنك لست مدرجًا في أي قائمة لدى حكومة الولايات المتحدة للأطراف المحظورة أو المقيّدة.

9. Third-party terms. You must follow any applicable third-party terms when you use Nowly, such as your mobile data or internet service agreement.

9. شروط الأطراف الثالثة. عليك الالتزام بأي شروط تنطبق من أطراف ثالثة عند استخدامك Nowly، كاتفاقية خدمة بيانات الجوال أو الإنترنت لديك.

10. Third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple has the right (and is considered to have accepted the right) to enforce them against you as a third-party beneficiary.

10. المستفيد من الطرف الثالث. Apple وشركاتها التابعة مستفيدة من هذه الأحكام ومن شروط الاستخدام كطرف ثالث. وبقبولك لها يثبت لـApple الحق (وتُعدّ قد قبلته) في الاحتجاج بها عليك بوصفها مستفيدًا من طرف ثالث.

11. Age. Nowly is for people aged 16 or older in every country, as the Terms of Use state.

Nothing in this section limits any right you have against Apple under Apple's own terms.

ولا يحدّ شيء في هذا البند من أي حق لك قِبَل Apple بموجب شروطها.

16.15 Severability, language and general terms

16.15 استقلال البنود واللغة وأحكام عامة

If any part of this section is found invalid or unenforceable, the rest remains in force and the invalid part is replaced by the nearest valid provision that achieves its purpose. If this section conflicts with another part of the Terms of Use about liability or warranties, this section prevails. Not enforcing a right is not a waiver of it. We may transfer our rights and duties to a successor of the operator of Nowly; you may not transfer yours. Headings are for convenience only. The Terms of Use, this section, the Privacy Policy, the Community Guidelines and Gold coins & In-App Purchases together are the entire agreement between you and us about Nowly, and replace any earlier understanding; the Apple-specific terms in section 16.14 apply alongside them.

إن تبيّن بطلان جزء من هذا البند أو عدم نفاذه، بقي سائره ساريًا، وحلّ محلّ الجزء الباطل أقرب حكم صحيح يحقّق غرضه. وإن تعارض هذا البند مع جزء آخر من شروط الاستخدام في شأن المسؤولية أو الضمانات، فالعبرة بهذا البند. وعدم إعمال حق لا يعني التنازل عنه. ويجوز لنا نقل حقوقنا والتزاماتنا إلى من يخلف مشغّل Nowly، ولا يجوز لك نقل حقوقك والتزاماتك. والعناوين للتيسير فقط. وتشكّل شروط الاستخدام وهذا البند وسياسة الخصوصية وإرشادات المجتمع وصفحة القطع الذهبية والمشتريات داخل التطبيق معًا الاتفاق الكامل بينك وبيننا بشأن Nowly، وتحلّ محلّ أي تفاهم سابق؛ وتسري معها الشروط الخاصة بـ Apple في البند 16.14.

These terms are published in Arabic and English. If the two versions conflict, the Arabic text prevails.

نُشرت هذه الشروط بالعربية والإنجليزية. وإذا تعارضت النسختان فالعبرة بالنص العربي.

These terms are governed by the laws of the Kingdom of Bahrain, and its courts have jurisdiction over any dispute, without prejudice to any mandatory consumer protections that apply to you in your country of residence.

تخضع هذه الشروط لقوانين مملكة البحرين، وتختصّ محاكمها بالنظر في أي نزاع، وذلك دون إخلال بأي حماية آمرة للمستهلك تسري عليك في بلد إقامتك.
